Property Tax Arbitration - When you don't like the Appraisal Review Board's Decision

Property Tax Arbitration, the final step after going through the Appraisal Review Board at the Travis County Central Appraisal District, or any other county in Texas.  You can file Arbitration through the state of Texas Comptroller's Office, and I go into detail here.

I want to explain a little more about what happens at the hearing.  If you're a homeowner, just because you know your one neighbor sold their home for $X, that does not mean you can or should base your entire case off one house.  When you come to an arbitration hearing and you have information for one property, you are not giving the arbitrator enough information to value your home.

The arbitrator also has to look at the evidence that the county Appraisal District provides. If they provide 20 comparable sales and you only provide the one, what evidence do you think gets more weight?  If they provide 7 comparable sales and you only provide the one, again, what evidence gets more weight.

Your market value is not determined by one sale nor is it determined by other homes' current tax value once you get to arbitration.  Arbitration is completely different than the Appraisal Review Board.

After you go to your arbitration hearing, the decision is binding. 
The value awarded is one value, and not broken down by land value and improvement value. It's up to the county to divide the number how they determine it should be broken down, but the arbitrator gives one value.

If you're not happy with the decision, don't attack the arbitrator.  Attack your own evidence. 
Award decisions are based on the evidence and the evidence alone.  It is not based on the Arbitrator's knowledge of your neighborhood.  The Arbitrator can only use evidence provided by both parties and award an unbiased decision based on the information given.  The Arbitrator cannot do outside research to help make their decision.  If you hear of an Arbitrator doing that, please report them to the Comptroller's office because that is against the rules of this Binding Arbitration.

If you have further questions about the Arbitration process, please don't hesitate to contact me.  Or if you're filing for Arbitration and you want to make sure you get someone knowledgeable about the process who will give a fair assessment, please put my name down on the form when you fill it out.  Arbitration isn't only done in person, but it can be done via phone across the state as well.

Rates Have Gone Up, How Much Buying Power Did You Lose?

Rates have moved above 5% again... how much buying power did you just lose?
Buying power?  What do you mean?

Your Buying Power is about how much you can afford and at what price.  The best buying power is when you can buy as much as you want for as little as you can.

Let's put it to numbers...

At a 4.5% 30 year fixed mortgage with 5% down, you could buy a house at $250,000 and pay a mere $1203.38 a month (not including taxes and insurance).

At a 5% 30 year fixed mortgage with 5% down, you could buy that same house for $1274.95 a month and a 5.5% rate at $1348.50 a month.

But Donna, I can only afford the $1203.38 a month.  That's what I set my budget at a year ago when I started looking...

No problem...  If you get a 5% rate and buy a house at $236,000 you can have a monthly payment of $1203.55.  If you continue to wait and get a rate of 5.5%, you can buy a house at $223,000 and have a payment of $1202.86.

Problem solved!!

But Donna, I don't like any of the houses in the lower price range which is why I've been looking in the higher price range!!

And?  What do you want me to do about it?  I've shown you house after house... perfect house after perfect house... you continued to "wait and see" and drive the parking lot... You've lost your buying power and there's nothing I can do about it.

What are some other options?  Put more money down. If you got a 5% rate, and put 10% down on a $250k house, you're payments would be $1207.85.  Right where you want to be.

You see how this can go in a circle?  The buyer will continue to wait to see if rates come back down, and when rates hit 6%, their buying power is only $211,000 for the same payment around $1200.  They lost almost $40,000 in buying power.

When you deal with higher price ranges, you deal with higher consequences. Here's an example staying below jumbo loan amounts of $417k so interest rates can compare apples to apples.
If you're looking at $439,000k at 4.5%, you're then looking at $414,000 with 5%, $392,000 with 5.5%, and $371,000 with 6%.  Just because you waited to see, and rates jumped up, your buying power decreased and decreased pushing down into a price range where you don't like what you can get.  You lost $68,000 worth of buying power to keep the same payments!

Are rates going to hit 4.5% again?  Who knows... probably not.  Will rates hit 6% again?  Yes. When?  Who knows, but probably sooner rather than too much later. Just over one year ago, in November of 2008, rates were at 6.75%.  Why do buyers think rates won't hit 7% again like in 2002?

If you don't want to lose your buying power throwing money down the drain, you need to make some decisions!

Happiest States to Live in... or are they?

There's this new report about the top 10 happiest states to live in, and I don't understand why it's being released with any weight when the study was done almost five years ago! The title says "Happiest States Revealed by New Research."  How could five year old research be "new" research?  SOOOOO much has happened in the past year, muchless five years.

For example, Louisiana tops the list, and there is a footnote that it might not be the happiest since it "... might not reflect current levels of well-being since the data were collected before the disruption caused by Hurricane Katrina."

Sorry, but another top state isn't very happy these days either!!  Florida is ranked third, yet they've got one of the highest foreclosure rates in the country with massive drops in home values and condo developments remaining empty.  They're happy??  It must be because of the "Happiest Place on Earth" - Disney World.

Where does your Happy State rank on LiveScience.com's list?  Texas ranks 16th, but yet so many cities within Texas are constantly on other top 10 lists, so how come we're not that happy?

How could this list be released as telling an accurate view of the happiest states in today's world when the world was so different so many years ago...

Is the Builder Responsible for Paying Subcontractors?

Centex Homes - Pulte Homes - New Construction Homes - Workers Defense Project - Austin TX - Should builders be responsible for paying workers if the contractors they hired don't pay them?

The Workers Defense Project in Austin TX is currently going after Centex Homes and Pulte Homes, which did merge in August 2009 so they are one company now. The claim is that the builders hired out the jobs on a house, like they do in every community, to contractors. The contractors have been paid. The contractors have not paid the subcontractors, the people who actually performed the work.

Is it fair for Centex and Pulte to be responsible for the contractors not paying their workers? If Centex and Pulte already paid their bills, is it fair to make them pay again?

Where does the liability start and where does it end? Yes, the work was done. Yes, Centex Homes and Pulte Homes paid the contractors. No, the subcontractors were not paid. But why is it fair for the Workers Defense Project to then demand the builders to reach back into their pockets and pay for the work again?

I understand they feel Centex and Pulte are taking low-bid jobs to save some money, but isn't everyone these days? If a contractor bids a job, and they can't afford to pay their own subcontractors, whose fault is that?

Here's a video showing their picketing outside the home office of Centex/Pulte and a model home, along with their reasons as to why they're demanding payment. Parts are in Spanish and not translated, but you get the idea.

Personally, as you can tell from the tone I wrote this, I don't think they have any right going after the builders when it's the contractors who aren't paying their workers...

Opening Presents is the Best!

'Tis the Season... My mom came into town this week to help Alyssa celebrate Hanukkah. I really don't know what Alyssa liked better, the candles or the presents.

When she turned two last month, that was the first time she really tried to open presents.  I think she figured it out because when her Hanukkah presents were put in front of her, she gave it her all!!


This Kitchen is a HUGE pain to put together!!  I did it myself, and I will warn you, do NOT try to follow the actual directions that came with it.  It will take you twice as long.  Just look at the pictures and use common sense, and you'll put it together very quickly.



She is loving putting things in the oven and microwave and pantry as well as in her shopping cart and shopping around the house... I showed her how to play pretend with the food pieces and she's got the hang of it, except she keeps trying to bite the hotdog!



So darn cute...

Lake Travis Kids R Kids - Shutting their doors...

Help save Lake Travis Kids R Kids!!

I have sympathy and empathy for the people who have been laid off over the past few months and years, but you never really know how bad it is until it affects you personally.

Granted, I haven't been laid off, however, many people in my immediate community have been which means many young kids have been taken out of school as families can't afford daycare, and how does that effect me?? 

I got a notice this morning that my daughter's daycare is closing, effective December 23.  Yes, right in the middle of the Holiday season, we're all scrambling to find new placement because enrollment has dropped considerably.

Currently, there are approximately 150 kids at this school, and there are only two other daycares in the area, not including the Montessori schools.  How are 150 kids going to find placement? 

I'm lucky that I don't have to make a knee-jerk reaction like others to get Alyssa into another school right now, as it's a little easier working from home than someone in corporate world who can't take their kids to work, so I'm letting those people grab the immediate openings.  Aren't I nice??!!

I've also made several calls this morning, and found a very nice gentleman who would like to buy the school and turn it into one of his schools. I have put him in touch with the attorney, and maybe I can help broker the sale as a short sale.  We'll see.

For now, I've been in constant contact with about 15 families today to keep everyone posted. 

Someone, please help us save our great school, Lake Travis Kids R Kids!!

Smelling Like an Ashtray is Not a Good Impression

ashtrayEveryone has a right to do whatever they want to their own bodies, and I respect that, but you should also respect others around you and recognize that you could be invading their space as well.

I had a meeting the other day, in a closed space, and I had to smell an ashtray for over an hour.  No, there wasn't an actual ashtray in the room, but two of the gentlemen who sat in on my meeting smelled like one.

If you're going to smoke, great, fine, they're your lungs and your health, I could careless.  However, if you know you're going into a meeting, is there something wrong with either not smoking right before the meeting, or standing outside for a few minutes to allow the lingering smoke to blow away to air out your hair and clothes?

I once dated a guy who smoked, and that was one of the reasons we broke up.  I made him go outside to smoke, but he would walk back in as he exhaled the last drag. Excuse me, but that just offset the purpose of smoking outside because you just brought the smoke inside.  I explained to him over and over again to let the breeze air him out before coming in, but he felt it was a bother...  Well, I felt it was a bother to deal with it and we broke up.

I respect that you want to smoke, but you need to respect that I don't want to inhale it from you! I ended that meeting as quickly as I, but it was still over an hour.

Recession Recovery - Austin TX - Best Retail Growth by Pitney Bowes

Recession Recovery - Austin TX has the Best Retail Growth in the U.S.!  That's right!  According to a new ranking put out yesterday by Pitney Bowes Business Insight, "Austin is the most likely city to experience retail growth for the rest of 2009 and into 2010."

This helps the area in many different ways, the biggest I think is consumer confidence.  If the consumers are more confident, they'll spend more.  If they spend more, sales go up, companies hire more people, unemployment goes down...  It's a chain reaction.

According to Pitney Bowes, the data includes sales from all different forms including high-end, mid-tier, and "value" retail sectors which I would assume means Walmarts and Targets.  Drug Stores like Walgreens are also included.

Does Austin stand alone in Texas?  Of course not! Texas has shown time and time again that they are weathering the recession much better than everyone else. Austin is ranked number one, but Houston is ranked third, Dallas is ranked fourth, and San Antonio is ranked fifth!

What if...

What if... he didn't show up?  What if... I decided not to answer my door?

Seven years ago, today, Mike showed up 25 minutes late for our blind date.  Can you imagine how mad I was when he hadn't showed up by 10 minutes late?  By 15 minutes late, and there was no phone call?? By 20 minutes...

I was told for almost two months that a friend of mine had someone he wanted me to meet. I was less than thrilled.  I received a call from my friend on Thanksgiving that year saying this guy agreed to meet me, but I was in Arizona visiting my parents. I told him I would call later that weekend.

I get a call on Wednesday, December 4, 2002 from some guy named Mike.  I had no idea who he was. It turned out to be the guy my friend was trying to set me up with.  We scheduled a Monday early dinner.  This is where it gets good.

Why a Monday?  He tells me a few years later that it was because he didn't want to ruin his weekend if things didn't go well.

How early of a dinner?  He was supposed to meet me at 4:30pm.  Why?  Because he didn't want to ruin his entire evening if things didn't go well.

Why was he so late?  He decided he wasn't going to show up!  I guess his conscience got the best of him to not leave me hanging, but he could have at least called to say how late he was running and could have used Dallas traffic as a believable excuse.

So, What if he didn't come?  What if he was any later, would I have answered the door?  .

Alyssa's artwork is definitely evolving.  This was a creation she made last week and asked "Can it go in mine purple room?" How could I refuse that as she asked so nicely... It hangs above her bed in her purple room. 

Don't you like her "signature".  She did it in several different colors so no one could miss it!

Houses for Sale - Austin TX Buyers - JUMP or Get off the Pot!

I previously wrote a blog post that talked about how buyers narrow down the properties they want to see from thousands to about 10-15 properties.  This is what happens from there...

The average first time home buyer, because they've seen so many listings on paper (meaning online), can and will buy a house the first day looking at properties in person within 5 houses they view. The average move-up buyer can and will buy a house the second time looking at properties in person within 7-8 properties they view.

Really?  No way! 

parking lotWith so much inventory, why wouldn't a buyer want to see every single listing available?  It's like chasing the open parking space in a parking lot.  You drive around to find the closest spot. You find one... but then decide there has to be a closer one.  You try to find it, and can't, so you go back to the other spot... but it's gone.

What happened?  It was a good spot and someone else saw it for what it was worth.

You continue to drive around to find a spot, and you find another one. You put your finger on it while you double check there isn't a better one... ooops, that spot it now gone too.

The cycle continues because you're afraid you're missing out on something if you don't see everything, but in reality, you found something you liked fairly early on in your search and you're afraid to commit, and when you're ready, the house is gone.  Many people repeat this cycle three and four times before finally realizing they need to "Jump or get off the pot!"

Did you find absolutely everything you were looking for in a house?  Probably not.  Do most people find everything they're looking for when they buy a house? NO! Most people make a list of their needs and wants.  Yes, the needs are important, but the wants can be compromised.  Do you need 3 baths, or is 2 1/2 going to work well for you?  Do you need 4 bedrooms, or will 3 bedrooms with a study work for you?

Once you can set your mind to actually wanting to buy a house, you'll understand how to look for what you need verse what you wantIf you're psychologically not ready to buy, you'll look at 50+ houses and never write an offer...  What fun is that?

Real Estate - Austin TX Homes for Sale - How Much is that Free Listing Costing you?

Real Estate - Austin TX Homes for Sale - The old adage is that you need to "spend money to make money", but why do so many people try to see what they can get for free?

house with money"I have a friend who's a Realtor, so she's going to list my house for free."
"What marketing is being done with your house to sell it?"
"It's just listed in the MLS. I'm not paying her to do anything else. I'm going to market it myself."
"You do realize the MLS listings feed out to multiple websites, so if your MLS listing doesn't have pictures or look good, it's still doing you no good, right?"
"What do you mean?  As long as it's listed, people will find it..."

And this conversation can go on and on and on and...

The vast majority of buyers are using the internet to begin their search these days.  Say a buyer puts in broad criteria like 3 bedrooms, 2 full baths, 2 car garage, priced $200-300k (substitute your market's price average if outside the Austin area).  There are literally thousands of listings that are available with that criteria.

How do buyers start to narrow things down? Besides adding criteria like 1 story verse 2 story, fireplace, pool or no pool, and age of the home, buyers start looking at pictures to help them visualize a property. If they like what they see in the pictures as well as the description the agent has painted in their brain, the house will stick out amongst the others.

The ones without pictures or limited pictures will get brushed aside.
  That list of thousands can then be narrowed down to a group of 10-15 properties a buyer wants to see.
