Donna Harris- Trained Texas Mediator

As of June 1, 2014, the Real Estate Residential sales contract now has mandatory mediation. Prior to June, Mediation was always an option for buyers and sellers. With so many cases in the courts, the Broker/Lawyer committee who creates the Texas real estate contracts decided to go ahead and make Mediation mandatory to see if the court system can take care of their back-log and if Mediation doesn't work, then the parties can go to court.

Because of this new clause in the contracts, I decided to take the Mediation training last month. In the state of Texas, there is no Mediation "certification" or "license".  You're either a "trained" mediator or you're not. You technically don't even need to be "trained" to market yourself and run a business as a Mediator. Every state is different.

I decided to suck it up, and schedule the time to take the class, and I went through the 5 day course, 40 hours. I received my cerfiticate and I'm ready to hear your cases. I've been a Property Tax Value Arbitrator for nearly 9 years so Mediation was the next gradual step in real estate disputes. Just another hat I wear to help ensure my clients get the best represetation there is.

Mediation is about Win/Win and the class at the Austin Dispute Resolution Center was awesome. Most of the 40 hours was role-play so we had the opportunity to play Mediator many times and get feedback from coaches and mentors they brought in.  I ususally hate role-playing, but I actually found myself volunteering to be the Mediator a few times instead of one of the disputing parties. I figured the best way to learn was to not hold back. It was so much fun. 

There were 28 people in the class with people from many walks of life. Only 2 real estate people. Most of the others were HR people in corporate world wanting to learn how to handle disputes with employees. The City of Austin had about 10 HR people there.  There was also a couple of attorney's so it was good to hear their perspectives as well.

I love mediation and I wish it was more popular in the real estate industry in New Hampshire.  I have had years of training, and enjoy seeing folks get to a win win resolution.
