Mediator for the Texas Association of Realtors

June of 2014 was a big change to our Texas residential real estate contracts. Mediation used to be an option that buyers and sellers could choose, but now it's mandatory. It used to be that if a suit went to court, the judge then had the option of hearing it or sending it to Mediation. Now, all cases must try Mediation first before seeing the inside of a court room. It's an Alternative Dispute Resolution.

donna harris mediation mediator dispute resolutionMediation is still "Voluntary" and can be stopped at any point in the process, but with the mandatory clause in the contract, it must be tried before moving forward.

Last month, I posted about how I took a 40 hour course to be a Trained Mediator in the state of Texas.  I followed that up taking the course in San Antonio last week that the Texas Association of Realtors has all approved Mediators take.

To become a Mediator for the TAR, you must have served on the Professional Standards Committee for at least 2 years. I've been on the committee since 2005. Also, you must get a recommendation from your board of Realtors as not just another can apply.  I was approved, and off to San Antonio I went for the all day class.

This one day class was very, extrememly different from the five day class I had just taken, but all the same points were there. Stay unbiased and treat both sides equally.

If you are a buyer or seller that is unhappy with the representation you had with a Realtor®, you may file a complaint with the Texas Association of Realtors for Mediation.  TAR cannot help you if you're a buyer or seller and you're upset with the party on the other side of the transaction. TAR Mediation must involve at least one member of the association.

However, since I've got the Mediation training for the state, if you're in a situation with another member of the public, you may contact me to see if Mediation would be the right step for you. Through Mediation, you might see more of a Win/Win situation rather than an "All or Nothing" situation a court room might decide for you.

Sounds like a good way to free up courtroom time, and a nice option for things to get worked out without the legal process coming into play.
