With my long tenure in real estate, wearing many hats, I finally decided to take my Mediation and Ombudsman experience out on my own and created Texas Real Estate Mediation Services.
The Texas contracts have a mandatory Mediation clause in every contract. Whenever something goes wrong and an agent contacts their broker, what is the immedaite response? "Lawyer up!" My goal is to change the mindset of people and get them to understand that not every situation needs an lawyer.
Mediation is less expensive than a lawyer. Mediation is a quicker process than litigating in our crowded court rooms, which is why judges want you to mediate first. Don't get me wrong, you are more than welcomed to have a lawyer represent you in a Mediation, I'm not saying having a lawyer is wrong. I'm just saying the Mediation process moves a lot quicker when there are not third parties involved and Sellers, Buyers, Tenants, Landlords, Brokers, and Agents could potentially be able to move on from a situation sooner rather than later.
